Welcome to The Bali Charm LLC (“The Bali Charm,” “We,” “Our,” or “Us”), a Company incorporated under the Laws of the State of Washington, USA. These Terms and Conditions (the “Terms”) govern your use of the website and services provided by The Bali Charm.
The Bali Charm is a travel service provider specializing in curated honeymoon and adventure packages in Bali, Indonesia. We cater to Customers (“Customer,” “You,” or “Your”) seeking eco-friendly and adventurous experiences during their honeymoon or vacation.
By accessing or using our website and services, you agree to comply with and be bound by these Terms and Conditions, along with any other guidelines, policies, or rules published by The Bali Charm on the website. If you do not agree to these Terms, please refrain from using our website or services.
ELIGIBILITY
- By accessing or using The Bali Charm website and services, you represent and warrant that to comply with the following eligibility requirements:
- You are at least 18 (Eighteen) years of age and have the legal capacity to enter into a binding agreement under applicable Law.
- You are legally able to form a binding contract under the Laws of your jurisdiction.
- You are not prohibited from using the services or website under applicable Laws, including but not limited to being subject to any legal restrictions, sanctions, or regulatory obligations that prevent you from using our services.
- If you do not meet the eligibility requirements outlined above, you may not use our services. The Bali Charm reserves the right to refuse or cancel any bookings if the eligibility criteria are not met.
SERVICES
The Bali Charm offers a wide range of travel packages and services designed to provide memorable experiences for honeymooners and adventure seekers. By using our services, you agree to the following terms:
- Description of Services: The Bali Charm provides various honeymoon and holiday packages, including but not limited to:
- Accommodation Booking: Secure and comfortable stays in selected hotels and resorts.
- Transportation Arrangements: Organizing transfers, private transport, and travel logistics.
- Customizable Travel Itineraries: Tailored itineraries designed to suit individual preferences, including relaxation or adventure options.
- Activity and Excursion Bookings: Activities such as ATVs, waterfalls, surfing, kayaking, scuba diving, and other exciting excursions.
- Packages Offered: The Bali Charm offers a variety of honeymoon and adventure packages based on various durations, such as:
- 5-day Land Package
- 5-day Water Package
- 7-day Land and Water Package
- 10-day Land and Water Package
- Detailed itineraries for each package can be found on our website. You can choose from a wide range of thrilling adventure activities, such as ATV rides, waterfall excursions, surfing, kayaking, scuba diving, and more. For additional details about each activity and package, please explore our website.
- These packages are designed to offer an unforgettable, eco-friendly, and adventurous honeymoon experience in Bali, Indonesia.
- Customised Packages: In addition to the aforementioned packages, The Bali Charm provides the option for Customers to customize their honeymoon packages based on specific preferences for adventure, relaxation, or other activities.
- Third-Party Suppliers: The Bali Charm works with third-party suppliers, including tour operators, hotels, and transportation providers, to facilitate the booking and execution of services for Customers.
- Service Availability: Our services and packages are subject to availability, and certain aspects of your booking may be modified based on Customer preferences or external factors, such as the availability of third-party suppliers.
BOOKING CONDITIONS
- Booking Process
- To make a booking, Customers must submit a request via The Bali Charm website or contact our Customer service team directly.
- A booking is considered confirmed once The Bali Charm has received either the full payment or the required deposit and has sent the Customer a confirmation email outlining the selected package, included services, and payment status. In addition, The Bali Charm will provide the Customer with a booking contract, which must be signed to confirm the package and proceed with the reservation. The deposit request will be included along with the booking contract.
- Alterations by you
- If, after we have issued our booking confirmation, you request a change in the dates or content of your trip itinerary, we will do our best to make these changes, but unfortunately, it may not always be possible.
- Booking Confirmation
- A booking is considered confirmed once you have paid the deposit and we have issued a booking confirmation, which will be sent via email. The confirmation will include the details of your travel arrangements, including the package, price, and any special requests.
DEPOSIT AND PAYMENT TERMS
- A non-refundable 20% (twenty percent) deposit is required to confirm your booking.
- The balance must be paid in full no later than 12 (Twelve) weeks before the departure date.
- If the booking is made within 12 (Twelve) weeks of the departure date, full payment is due at the time of booking.
- The Bali Charm may also provide specific payment terms at its sole discretion, which will be outlined in the booking confirmation contract provided to the Customer.
- Payments must be made through the secure payment methods available on the website. Payment methods accepted include Zelle or Venmo, and additional charges may apply for payments via credit or debit cards.
- The Bali Charm reserves the right to cancel any booking for which full payment has not been received by the due date.
PRICING
- The prices for The Bali Charm’s travel packages and related services are listed on our website. For specific pricing details, features, and any applicable conditions, please refer to the individual package descriptions on the website. All transactions and payments to The Bali Charm will be conducted and must be paid in United States Dollars (USD).
- For customized packages, pricing and service details will be provided directly by The Bali Charm’s customer service team. These tailored packages may vary in price depending on the Customer’s specific requirements and preferences, and final pricing will be confirmed through direct communication and outlined in the booking confirmation contract.
- Inclusions and Exclusions:
- Inclusions: Prices include accommodation, specified meals, and activities as listed in your chosen package.
- Exclusions: Prices do not include travel insurance, excess baggage charges, tipping, additional excursions or activities, and any food or drink not specified as part of your trip.
- Price Changes: Prices are subject to change with notice due to factors such as seasonality, exchange rate fluctuations, or other unforeseen circumstances.
CANCELLATIONS
- Cancellation by Customers:
- You may cancel your travel arrangements at any time. Cancellation instructions must be made in writing by the Customer and sent to the following email address: admin@thebalicharm.com. This will be effective on the day we acknowledge receipt of your request by reply..
- Unfortunately, we incur costs when cancelling your booking, which you will be required to pay in accordance with our cancellation charges set out below:

Note: The deposit is non-refundable under any circumstances.
REFUND:
- Any refundable amounts will be processed after deducting the applicable cancellation charges, and refunds may take up to 30 (Thirty) days to be processed.
- Refunds will be made via the same payment method used at the time of booking. Please note that the time it takes for the refund to appear in your account may vary depending on your bank or payment provider.
- Documentation:
- To facilitate the refund process, Customers may be required to provide supporting documentation, such as bank statements or payment confirmations, upon request.
- Currency Fluctuations:
- Refunds will be processed in United States Dollars (USD). The Bali Charm is not responsible for any losses due to fluctuations in currency exchange rates between the time of the original payment and the time of the refund.
- Cancellation by The Bali Charm:
- In the rare event that we need to cancel your booking, we will offer a full refund, excluding any non-refundable fees or charges paid to third-party suppliers such as airlines, hotels, or assist in arranging alternative accommodations or services.
- No-Show Policy:
- If you fail to show up on the scheduled date of departure or do not arrive at your scheduled destination without notifying us beforehand, no refunds will be given, and the full payment will be forfeited.
CHANGES TO BOOKINGS
- By Customer: If you wish to alter your booking, such as changing travel dates, adjusting the itinerary, requests for changes to bookings must be made through email. While we will endeavor to accommodate such requests, we cannot guarantee that changes or availability and may impose additional fees for any changes made.
- By The Bali Charm: We reserve the right to make minor changes to your booking arrangements, such as change in changes to accommodation, activities, etc. If a significant change occurs, we will offer alternative options, including a refund or adjustment to your booking, depending on your preference.
CUSTOMER RESPONSIBILITIES
As a Customer of The Bali Charm, you agree to the following responsibilities to ensure a smooth and enjoyable experience while using our services:
- Travel Documents
- You are responsible for ensuring that you possess all necessary travel documents, including but not limited to a valid passport, visas, and any other documents required.
- Health Precautions
- Customers are responsible for ensuring that they take appropriate health precautions before traveling, including consulting with a healthcare provider to receive any necessary vaccinations or medical treatments recommended for travel to Bali, Indonesia, or any other destinations in your itinerary.
- If you have any existing medical conditions or special health requirements, you must inform The Bali Charm at the time of booking so we can take appropriate steps to accommodate your needs, subject to availability.
- Accurate Information
- You are responsible for providing accurate, complete, and up-to-date information at the time of booking and throughout your interaction with The Bali Charm. This includes your personal details, such as name, contact information, travel dates, preferences, and any other relevant information that may affect your trip.
- Any failure to provide accurate information may result in delays or cancellations of your booking or services, and you may be held liable for any costs incurred due to incorrect or incomplete information.
- Compliance with Local Laws
- Customers must comply with all local Laws, Regulations, and customs while traveling. This includes adhering to any legal requirements set by the government of Bali, Indonesia.
- The Bali Charm will not be held responsible for any fines, penalties, or legal consequences incurred due to the Customer’s failure to comply with these Laws or Regulations.
- It is the Customer’s responsibility to ensure that they meet all entry and exit requirements, including compliance with any customs or immigration controls.
- Behavior and Conduct
- Customers are expected to behave in a respectful and courteous manner towards all individuals, including other travelers, local residents, and the staff of The Bali Charm and any third-party service providers.
- Any disruptive, abusive, or offensive behavior will not be tolerated. The Bali Charm reserves the right to cancel or terminate the services provided to any Customer whose behavior is deemed inappropriate, without a refund.
- Customers must not engage in illegal, harmful, or disruptive activities during their trip. This includes but is not limited to behavior that endangers the safety or well-being of others, damages property, or violates any Laws or Regulations.
- Coordination and Cooperation with Third-Party Suppliers
- The Bali Charm works with various third-party suppliers, including tour operators, hotels, transportation providers, and activity organizers. You agree to fully cooperate and coordinate with these suppliers to ensure smooth and efficient service delivery.
- You must follow the instructions provided by these third-party suppliers, including safety guidelines, operational procedures, and any other requirements necessary for the successful completion of activities or services.
- If you encounter any issues or concerns with third-party suppliers during your trip, you agree to notify The Bali Charm promptly, and we will work to address the situation. However, The Bali Charm will not be held liable for any disputes or issues arising directly from third-party services.
- No Damage to Property
- You agree not to cause any damage to any property, whether owned by The Bali Charm, our third-party suppliers, or other individuals, during your trip. This includes damage to hotel property, vehicles, equipment, or any other facilities provided as part of the services.
- If you or any member with you causes damage to any property, you will be held financially responsible for the repair or replacement costs.
- The Bali Charm reserves the right to seek compensation for any damages caused, and failure to comply with these responsibilities may result in the termination of services without refund.
INDEMNITY
- Indemnification by the Customer: The Customer agrees to indemnify, defend, and hold harmless The Bali Charm, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney’s fees arising out of or in connection with:
- The Customer’s use or misuse of the website or services.
- Any violation of these Terms and Conditions or other applicable policies by the Customer.
- Any content submitted by the Customer, including but not limited to Customer reviews, feedback, and any other materials that infringe upon the intellectual property rights, privacy rights, or any other rights of third parties.
- Any legal claims, disputes, or actions arising from the Customer’s participation in any activities or bookings facilitated by The Bali Charm, including but not limited to tours, adventures, and services provided by third-party service providers.
- Any injury, loss, or damage sustained by the Customer or any third party arising out of or during the Customer’s use of The Bali Charm’s services.
- Indemnification by The Bali Charm: The Bali Charm agrees to indemnify, defend, and hold harmless the Customer from any claims, damages, liabilities, costs, and expenses, including reasonable attorney’s fees arising out of or in connection with:
- The Bali Charm’s breach of these Terms and Conditions.
- The Bali Charm’s negligence or willful misconduct during the provision of its services.
- Survival of Indemnity Obligations: The indemnity obligations outlined in this section shall survive 1 year after the termination or expiration of the Customer’s service plan with us.
CONFIDENTIALITY
- Confidential Information: While using The Bali Charm website or engaging with The Bali Charm’s services, both The Bali Charm and the Customer may have access to certain confidential information, including but not limited to business operations, Customer data, financial information, pricing, proprietary systems, and any other non-public information (collectively, “Confidential Information“).
- Obligations of the Parties: Both parties agree to maintain the confidentiality of all Confidential Information and shall not disclose, use, or permit the use of such information for any purpose other than the performance of the services provided under these Terms and Conditions. This obligation shall continue even after the termination of the relationship between the parties.
- Exclusions: Confidential Information does not include information that:
- Was publicly available at the time of disclosure or became publicly available without breach of this clause.
- Was already known by the receiving party prior to disclosure.
- Is disclosed to third parties with prior written consent from the disclosing party.
- Is required to be disclosed by Law, Regulation, or legal process, provided the receiving party promptly notifies the disclosing party of such requirement.
- Return or Destruction of Confidential Information: Upon termination of services or at the disclosing party’s request, the receiving party shall promptly return or destroy any Confidential Information provided, along with any copies or reproductions, unless otherwise required to retain such information by Law or Regulation.
- Remedies: Both parties acknowledge that any unauthorized disclosure or use of Confidential Information may cause irreparable harm, for which monetary damages may be insufficient. Therefore, the disclosing party shall have the right to seek injunctive relief or other equitable remedies in the event of a breach of this confidentiality obligation.
INTELLECTUAL PROPERTY RIGHTS
- Ownership of Content: All content on the Bali Charm website, including text, graphics, logos, images, and videos, is owned by The Bali Charm or its licensors and is protected by Intellectual Property Laws. Customers are granted a limited, non-transferable license to use the content for personal, non-commercial purposes.
- Customer Content: By submitting content, including but not limited to reviews, photos, and videos. Customers grant The Bali Charm a license to use, modify, and distribute the content for its services, ensuring they have the necessary rights to do so.
- Third-Party Content: The website may include content owned by third parties, and The Bali Charm uses such content under license or permission, with all rights retained by the third parties.
- No Transfer of Ownership: Customers do not gain any ownership rights to The Bali Charm’s or third parties’ intellectual property, except for the limited rights granted.
- Breach of Intellectual Property Rights: In the event of any breach of these intellectual property provisions, including unauthorized use of The Bali Charm’s Content, Customers may be subject to legal action, including claims for damages and injunctive relief. The Bali Charm reserves the right to take legal steps to protect its intellectual property and seek compensation for any harm caused. Additionally, unauthorized use may result in the suspension or termination of access to the website and services.

- The Bali Charm is committed to protecting the privacy and personal data of our customers. To facilitate your booking and ensure the seamless delivery of your travel arrangements, The Bali Charm collects and processes personal data provided by you during the booking process in accordance with all applicable data protection laws.
- This includes, but is not limited to, the following legal frameworks:
- Washington Privacy Act (WPA): As we are based in Washington, we adhere to the WPA, which sets guidelines for data collection, processing, storage, and transfer. This includes ensuring lawful bases for processing personal data, obtaining explicit consent where necessary, and providing rights to access, rectify, and erase personal information.
- Foundational Data Privacy Act (FDPA): We also comply with the FDPA. This ensures transparency in data processing, the establishment of lawful bases, and the enforcement of your rights, such as access, correction, and deletion of your personal information.
- Other Jurisdictions: We also comply with any other relevant International Privacy Laws and regulations applicable in different regions, ensuring compliance with local standards for the protection of personal data.
- The personal data we collect may include but is not limited to:
- Full name, email address, phone number, and residential address;
- Passport and identification details;
- Health information or medical conditions (if relevant to your travel needs);
- Dietary requirements or accessibility preferences;
- Information related to minors;
- Any other information that we consider necessary.
- This information will be shared with our trusted suppliers, which include, but are not limited to, accommodation providers, airlines, transportation companies, and other third-party service providers involved in completing your booking process. We ensure that such sharing is done in compliance with all applicable data protection laws.
- Additionally, we may share your data with credit-checking companies, public authorities (such as customs and immigration), or other entities when required by Law or for regulatory purposes, and always under the framework of applicable data protection laws.
PRIVACY POLICY
- The Bali Charm collects personal information necessary for booking and facilitating services. By using our services, you consent to the collection and processing of your personal data in accordance with applicable privacy Laws.

TRAVEL INSURANCE
- We strongly recommend that all Customers obtain comprehensive travel insurance that covers trip cancellations, medical expenses, personal liability, and other unforeseen events. It is essential to understand the various types of coverage that may be included in a travel insurance policy:
- Trip Cancellations: This coverage can protect you in the event that you need to cancel your trip due to unforeseen circumstances such as illness, injury, or a family emergency. It may reimburse you for non-refundable expenses, such as your booking deposit or any pre-paid services, in the event of cancellation.
- Medical Expenses: Comprehensive travel insurance should include coverage for medical treatment, including emergency medical care, hospitalization, and medical evacuation in case of serious illness or injury while traveling. This is particularly important for international travel, as medical costs in foreign countries can be high, and your domestic health insurance may not cover such expenses abroad.
- Personal Liability: This coverage protects you if you are held legally responsible for injury or damage to third parties or their property during your trip. This may include accidents, property damage, or any incident for which you could be deemed responsible under the Law.
- Lost or Delayed Baggage: Travel insurance may also cover lost, stolen, or delayed baggage, ensuring that you are compensated for essential items you may need to replace if your luggage is misplaced or delayed by airlines.
- Travel Delays: This covers expenses incurred due to delays in your travel arrangements, such as accommodation or meals during long delays, and compensation for missed connections or changes to your travel itinerary caused by unforeseen events.
- Emergency Assistance: Many travel insurance policies include access to 24/7 emergency assistance, providing you with support for emergencies such as lost passports, legal assistance, and emergency cash transfers during your trip.
- Cancellation and Medical Evacuation: For Customers traveling to destinations with specific health risks, emergency evacuation coverage can ensure that you are transported to a safe location or back home in the event of a medical emergency.
- Claim Process:
- In the event of an incident that requires insurance claims, it is your responsibility to contact your insurance provider directly to file and process your claim. The Bali Charm will not be involved in the claims process, and any claims will be subject to the terms and conditions of your travel insurance policy.
LIABILITY
- General Limitation of Liability: The Bali Charm, its directors, employees, agents, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your travel arrangements, including but not limited to injury, illness, death, loss of personal belongings, or damage to property.
- Third-Party Suppliers: Many of the services that make up your travel package are provided by independent third-party suppliers, such as hotels, airlines, tour operators, activity providers, and transportation companies. While we make reasonable efforts to ensure that these partners are reputable and deliver quality services, The Bali Charm has no direct control over their operations and shall not be held liable for any acts, omissions, negligence, or failure to perform on their part.
- Personal Responsibility and Assumption of Risk: By participating in any activity or travel service arranged through The Bali Charm, you acknowledge that there may be inherent risks associated with travel and adventure activities. You agree to assume full responsibility for your participation and for any consequences arising therefrom. This includes, but is not limited to, injuries or losses during excursions such as ATVs, scuba diving, or other physically demanding experiences.
FORCE MAJEURE
- Force Majeure Event: The Bali Charm shall not be held liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters such as earthquakes, tsunamis, volcanic eruptions, floods, wildfires, or landslides, or extreme weather conditions, acts of God, war, terrorism, civil unrest, pandemics or infectious disease outbreaks, labor strikes or industrial disputes, government actions or restrictions including travel bans, quarantine requirements, or changes in laws and regulations, airport or airspace closures, and any other unforeseeable events that prevent The Bali Charm from fulfilling its services. In such cases, The Bali Charm shall be excused from performance without any liability to the Customer.
- Notification:
- In the event of a Force Majeure Event, the affected party must promptly notify the other party in writing of the occurrence of such an event and provide reasonable details of its nature and expected duration, if known. The initial notice must be given within 3 days of the event’s occurrence.
- Mitigation:
- The affected party will make reasonable efforts to mitigate the impact of the Force Majeure Event and resume performance of its obligations as soon as reasonably practicable.
- Effects of Force Majeure:
- The Bali Charm shall not be liable for any delays, disruptions, changes, or cancellations of travel arrangements caused by Force Majeure Events.
- While The Bali Charm will make reasonable efforts to assist you in making alternative arrangements where possible, any additional costs incurred as a result of a Force Majeure Event, including but not limited to costs for alternative accommodation, transportation, or repatriation, shall be your responsibility.
TERMINATION
- Termination by The Bali Charm: The Bali Charm reserves the right to terminate or suspend a Customer’s booking, access to the website, or services at its sole discretion, without prior notice, in the event of any of the following:
- Violation of these Terms and Conditions or any other applicable policies.
- Failure to make payment for booked services within the specified time frame.
- Engaging in prohibited conduct, including but not limited to illegal activities, harassment, or damage to the reputation of The Bali Charm or its service providers.
- Any other conduct that, in The Bali Charm’s reasonable opinion, disrupts the proper functioning of its services or the enjoyment of other Customers.
- No refund: In the event of termination for the reasons listed above, no refunds will be provided. Additionally, Customers may be held liable for any damages or losses caused by their breach of these Terms and Conditions.
- Termination by the Customer: Customers may terminate their booking or services by providing written notice to The Bali Charm at least 14 days before the scheduled departure or service date. Cancellations will be subject to The Bali Charm’s cancellation policy, as outlined in these Terms and Conditions.
- Effect of Termination: Upon termination of a booking or service, all rights granted to the Customer under these Terms and Conditions shall immediately cease, including access to the website and any associated services. Customers shall remain liable for any amounts owed to The Bali Charm for services provided up until the date of termination.
GOVERNING LAW AND JURISDICTION
- These Terms and Conditions shall be governed by and construed in accordance with the Laws of the State of Washington, USA. Any legal action, claim, or proceeding arising out of or in connection with these Terms and Conditions shall be exclusively brought in the competent Courts located in Seattle, Washington, USA.
DISPUTE RESOLUTION
- In the event of any dispute, claim, or controversy arising out of or in connection with these Terms and Conditions, the parties agree to first attempt to resolve the issue through good-faith negotiation. The party raising the dispute shall provide written notice to the other party, and both parties shall use reasonable efforts to resolve the matter amicably within 30 (Thirty) days from the date of the notice.
- If the dispute cannot be resolved through negotiation, the parties agree to submit the matter to mediation before a neutral third-party mediator in Seattle, Washington, with the goal of reaching a mutually agreeable solution. If the dispute is not resolved through mediation, it shall then be resolved through binding arbitration in Seattle, Washington, in accordance with the rules of the American Arbitration Association (AAA). The arbitration will be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding. Both the mediation and arbitration processes shall be confidential, and the arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.
CHANGES TO TERMS AND CONDITIONS
- The Bali Charm reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on the website, and the revised Terms and Conditions will be effective immediately upon publication.

ASSIGNMENT
- Customers may not assign, transfer, or sublicense any of their rights or obligations under these Terms and Conditions without the prior written consent of The Bali Charm. The Bali Charm may assign or transfer its rights and obligations under these Terms and Conditions at any time without notice to or consent from the Customer.
SEVERABILITY
